Compensation claims still ticking along through COVID

The global community has changed dramatically over the last 3 months. Australia has seen strict lockdown restrictions due to COVID-19 with many employees either losing jobs, being stood down or moved to work from home arrangements.

One thing that has remained consistent and virtually unaffected during the lockdown has been the progression of compensation claims for injured Claimants.

Whilst many legal firms have been detrimentally impacted by COVID-19, the personal injury and dust disease compensation practices have carried on and stayed strong. The only real difference Claimants are likely to have experienced is the sound of a barking dog during a recent conversation with their lawyer working from home.

Many firms moved to working from home arrangements during the strict lockdowns which still allowed for claims to be progressed in an efficient and effective manner. With the courts remaining open and insurers continuing to operate, it has ensured that compensation claims have continued to be progressed with little to no disruption.

It is also important that the injured and sick are not disadvantaged during this challenging time. Whilst there can be no doubt COVID-19 has had a detrimental impact on many individuals and businesses, it is important that legal representatives ensure compensation payers are not using it as an opportunity to take advantage of a Claimant’s damages claim.

Australia will recover from COVID and individuals affected will return to some form of employment or reopen and continue to build their business. If a Claimant has been injured and continues to be impacted by their injuries, they are still entitled to damages regardless of COVID.

It is important this is recognised by compensation payers and legal representatives are maximising the damages claim for their clients.
